Terms & Conditions

In this agreement we refer to you, the purchaser as “you” or “your” and nzscales.co.nz as “us”, “we” or “our”.

GENERAL

This agreement applies to all purchases of NZ Vase Ltd Products by you from the nzscales.co.nz website and replaces all previous agreements between you and us.

We may change the terms of this agreement from time to time using the process set out in clause 17.

This agreement is important. You should ensure that you have read it thoroughly prior to purchasing any products on our website.

DEFINITIONS

In this agreement unless the context otherwise requires:

• “agreement” means this agreement and includes any other terms incorporated into it by reference;

• “information” means all information supplied by you to us via the website or otherwise, including your name, contact details, credit card details, and transaction history;

• “GST” means goods and services tax;

• “late payment interest rate” means 1.5%;

• “products” means all products available for purchase on our website;

• “website” means our website accessible via the nzscales.co.nz domain name.

PURCHASE TERMS

When purchasing products on the website you confirm and acknowledge that:

(a) you are 18 years old or over (where applicable) and legally permitted to purchase restricted products, and can provide valid identification upon request;
(b) all information supplied by you is true and correct;
(c) we may refuse to accept your order at our sole discretion;
(d) we may disclose your information to your bank/credit provider or for debt recovery purposes;
(e) we may impose a credit limit on your account restricting purchases.

PRICE

Product prices quoted on our website are inclusive of GST. You must pay the full quoted price.

We reserve the right to vary prices without notice.

TRANSIT COST

Product prices are exclusive of delivery or transit costs. Courier or handling charges will be added at checkout.

MISTAKES IN PRICE ARISING FROM COMPUTER ERROR

If a pricing error occurs due to a system mistake, we may require payment of the difference between the incorrect amount paid and the correct price.

If the error is identified before delivery, we will attempt to notify you, and you may cancel the affected portion of your order.

PRODUCT AVAILABILITY

All products are subject to availability. We are not responsible if items are out of stock or unavailable.

If we cannot supply the full quantity ordered, you may cancel or adjust your order by agreement.

Online product availability and pricing may differ from in-store availability and pricing.

DELIVERY & TRANSIT

Orders placed before 3pm will be dispatched the same day. Orders placed after 3pm will be dispatched the next business day.

Orders placed on Friday will be dispatched for delivery on Monday.
Orders placed on Saturday or Sunday will be dispatched for delivery on Tuesday.

We aim to dispatch orders within two business days of confirmation. Delivery delays caused by external factors are not our responsibility.

If delivery fails, you may cancel undelivered items unless otherwise agreed.

Our liability for delivery issues is limited to replacement of the order or part thereof at our discretion.

You must report shortages or transit damage within three days of receipt.

Delivery is considered complete once goods reach the specified address.

PAYMENT TERMS – CHARGES & INVOICING

Payment must be made in full at the time of order unless credit terms are agreed.

If paying by credit card, you agree to cover any failure of your card provider to complete payment.

If credit terms are granted, payment must be made within 19 days of the order date, unless otherwise revoked at our discretion.

REMEDIES FOR NON-PAYMENT

We will charge interest at 1.5% per month on overdue amounts. Interest accrues daily and continues even after judgment.

We reserve the right to recover unpaid goods. You agree we are not liable for any loss arising from recovery unless due to our negligence.

All collection costs will be charged to you.

WARRANTIES

We warrant that:

(a) we have the right to sell the products;
(b) the products are not subject to undisclosed encumbrances;
(c) you have the right to undisturbed possession.

We also warrant that products:

(a) are of acceptable quality;
(b) are reasonably fit for their intended purpose;
(c) match their description.

CANCELLATION, RETURN AND REPLACEMENT

Subject to clause 8:

(a) orders cannot be cancelled without our consent once accepted;
(b) cancellation may be refused if processing has begun;
(c) returns are at our discretion and return costs are your responsibility;
(d) cancellation may incur a handling fee of $4.00 (ex GST) per case or up to 15% of order value.

USE OF YOUR INFORMATION

We collect and store information such as IP address, contact details, and transaction history.

This data may be used for account management, credit checks, marketing, and operational purposes.

You may request access to or correction of your personal data at any time.

CONSENT TO ELECTRONIC MESSAGES

By registering, you consent to receive marketing communications. You may opt out at any time.

INTELLECTUAL PROPERTY RIGHTS

All website content is owned or licensed by us. You may use it for personal use only.

Reproduction, distribution, or public display without permission is prohibited.

GENERAL TERMS

NO WAIVER

Failure to enforce any provision does not waive rights.

SEVERABILITY

If any clause is invalid, the remainder remains enforceable.

PRIVITY

Third parties may benefit under applicable law where relevant.

JURISDICTION

This agreement is governed by New Zealand law. Any disputes must be resolved in New Zealand courts.

ASSIGNMENT

You may not assign rights without our consent. We may assign our rights freely.

NOTICES

Notices will be sent to your provided contact details.

Notices are deemed received:
(a) immediately if sent by email/fax;
(b) four days after posting.

AMENDMENTS

We may amend these terms by issuing notice. Changes take effect within the timeframe stated in the notice, not exceeding 30 days.

COUPON TERMS

• Promotional codes are valid for limited periods and may be changed or cancelled at any time.

• Each code is single-use unless otherwise specified.

• Codes apply only to qualifying items.

• Codes are non-transferable and cannot be redeemed for cash.

• Refunds on discounted items will deduct the coupon value.

• Only one coupon may be used per order and cannot be combined with other offers.

• Limit one coupon per customer.

• Orders using invalid or misused coupons may be cancelled.

• Login or registration may be required for coupon activation.

• Violation of terms invalidates promotional discounts.

NZ Vase Ltd reserves the right to update these terms and conditions without prior notice.
